Terms of Service

1. Agreement
By accessing or using abunsh.com and the Abunsh web application (collectively, "the service"), you agree to these Terms of Service ("the terms") and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the service. You represent that you are able to form a binding contract with us. Section 15 contains a binding arbitration agreement and a class-action waiver that affect how disputes are resolved — please read it carefully.
2. Description of service
Abunsh is a data and analytics tool that ranks US property locations using leading supply and demand signals, and surfaces asset-type detail ("Property Standouts") derived from recorded sales. The service is provided on a Free tier (limited features, no signup required) and a Pro tier (full features, paid subscription). Outputs are informational descriptions of data — not advice (see section 8).
3. Eligibility
You must be at least 18 years old to use the service. By using the service, you represent that you meet this requirement and that your use complies with all laws applicable to you.
4. Accounts
- You may create an account to subscribe to monthly market updates or to purchase a Pro subscription. Sign-in is by emailed "magic link"; you are responsible for the security of your email account.
- You are responsible for all activity that occurs under your account.
- You agree to provide accurate information and to keep it up to date.
- You may delete your account at any time by emailing hello@abunsh.com.
5. Subscriptions, billing, and automatic renewal
- Recurring billing: The Pro tier is offered as an automatically renewing subscription. Unless you cancel, it renews automatically at the end of each billing period (monthly, or as shown at checkout) and your payment method is charged the then-current price for each new period. The Research Pass, where offered, is a one-time charge and does not renew.
- Price and terms are presented on the Pricing page and at checkout before you purchase. Prices may change for future billing periods with prior notice; the change applies on your next renewal.
- How to cancel: You may cancel anytime from your account settings ("Manage billing") or by emailing us. Cancellation stops future renewals and takes effect at the end of the current paid period; you keep Pro access until then.
- Payments are processed by Stripe; by subscribing you also agree to Stripe's terms. We do not store your card details.
- Refunds: requests within 7 days of your initial Pro upgrade may be granted at our discretion; otherwise charges are non-refundable except where a refund is required by law.
- If a charge fails, Pro access may be suspended until payment is restored.
6. Acceptable use
You agree not to:
- Resell, redistribute, sublicense, or commercially exploit Abunsh's data outputs without our written permission.
- Use the service to violate any law or third-party right.
- Reverse-engineer the service, use bots/scrapers, access the service by automated means, or circumvent the technical limits or paywall of the Free tier.
- Upload, transmit, or distribute malicious code, or attempt to disrupt, overload, or gain unauthorized access to the service or its infrastructure.
- Use the service to send unsolicited communication or spam.
7. Intellectual property
The service — including its software, design, methodology, scores, copy, and aggregated data outputs — is owned by Abunsh and protected by intellectual property laws. We grant you a limited, revocable, non-transferable, non-exclusive license to use the service for your own personal or internal business research. All rights not expressly granted are reserved. You retain ownership of any content you submit, and grant us a license to use it as needed to operate the service.
8. Feedback
If you send us ideas, suggestions, or feedback, you grant us a perpetual, worldwide, royalty-free license to use it for any purpose without obligation or compensation to you.
9. Third-party services and data
The service relies on third-party providers (e.g., Stripe, Supabase, Vercel, Resend) and on data from public and commercial sources. We are not responsible for third-party services or for the accuracy, completeness, or availability of third-party data, and your use of any third-party service is governed by that party's terms.
10. Changes to the service
We are continually improving the service and may add, change, suspend, or discontinue features (including data signals, tiers, or the Property Standouts feature) at any time, with or without notice. We are not liable to you for any modification, suspension, or discontinuation of the service.
11. No investment advice
Abunsh is a data and analytics tool. It is not investment advice, financial advice, legal advice, tax advice, real-estate brokerage, appraisal, or professional advice of any kind, and no fiduciary relationship is created. The Demand Score is a ranking that reflects the signals you choose to weight; Property Standouts describe past recorded sales. Neither is a recommendation to buy, sell, or hold any property. Past performance does not guarantee future results, and property markets carry significant risk and can decline in value. You are solely responsible for your decisions. Always do your own due diligence and consult appropriately licensed professionals before investing.
12. Disclaimer of warranties
The service is provided "as is" and "as available" without warranties of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free, or that any data, score, or output will be accurate, current, or complete. Some jurisdictions do not allow the exclusion of certain implied warranties, so some of the above exclusions may not apply to you.
13. Limitation of liability
To the maximum extent permitted by law, Abunsh, its operator, and its service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, capital, data, goodwill, or business interruption, arising out of or relating to your use of (or inability to use) the service, even if advised of the possibility. To the maximum extent permitted by law, our total aggregate liability for all claims relating to the service will not exceed the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) USD $100. Some jurisdictions do not allow the limitation or exclusion of certain damages, so some of the above may not apply to you; in such cases our liability is limited to the smallest amount permitted by law.
14. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Abunsh and its operator from any claim, loss, liability, or expense (including reasonable legal fees) arising out of your breach of these terms, your misuse of the service, your content, or your violation of any law or third-party right.
15. Dispute resolution — arbitration & class-action waiver
Please read this section carefully — it affects your legal rights. Most concerns can be resolved quickly by emailing us first, and you agree to try informal resolution for 30 days before starting a formal proceeding.
- Agreement to arbitrate: Except as set out below, you and Abunsh agree that any dispute arising out of or relating to these terms or the service will be resolved by final and binding individual arbitration, rather than in court. The U.S. Federal Arbitration Act governs the interpretation and enforcement of this provision. Arbitration will be administered by a recognized arbitration provider (e.g., the American Arbitration Association) under its consumer arbitration rules.
- Class-action & jury waiver: Disputes will be conducted only on an individual basis. You and Abunsh waive any right to a jury trial and any right to bring or participate in a class, collective, or representative action.
- Exceptions: Either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court to protect intellectual property or stop unauthorized use of the service.
- 30-day opt-out: You may opt out of this arbitration agreement by emailing hello@abunsh.com within 30 days of first accepting these terms, stating your intent to opt out. Opting out does not affect any other part of these terms.
- Severability: If the class-action waiver is found unenforceable as to a particular claim, that claim will proceed in court while the rest of this section remains in force.
16. Governing law and venue
These terms are governed by the laws of New South Wales, Australia, without regard to conflict-of-laws rules, except that the U.S. Federal Arbitration Act governs section 15. Subject to the arbitration agreement above, and to any mandatory consumer-protection rights of your home state or country that cannot be waived, any dispute not subject to arbitration will be brought in the courts of New South Wales, Australia.
17. Termination
We may suspend or terminate your access at any time, including for suspected violation of these terms, with or without notice. You may stop using the service at any time. Sections that by their nature should survive termination — including intellectual property, feedback, disclaimers, limitation of liability, indemnification, dispute resolution, governing law, and miscellaneous — will survive.
18. Electronic communications and notices
You consent to receive communications from us electronically (by email and by notices posted on the site), and you agree that electronic communications satisfy any legal requirement that a communication be in writing. Legal notices to us should be sent to hello@abunsh.com.
19. Changes to these terms
We may update these terms periodically. Material changes will be communicated by email to active subscribers and noted at the top of this page with a revised "last updated" date. Continued use of the service after changes take effect constitutes acceptance of the revised terms.
20. Miscellaneous
- Entire agreement: these terms and the Privacy Policy are the entire agreement between you and Abunsh regarding the service and supersede prior agreements.
- Severability: if any provision is found unenforceable, the rest remains in effect.
- No waiver: our failure to enforce a provision is not a waiver of it.
- Assignment: you may not assign these terms; we may assign them in connection with a merger, acquisition, or sale of assets.
- Force majeure: we are not liable for delays or failures caused by events beyond our reasonable control.
- Headings are for convenience only.
